This agreement is put in place so you know exactly what a session with us entails and to ensure that we are able to deliver on your expectations. Please read all information carefully, and if you have any questions at any time, just ask.

| terms |

“studio” means Natasha Jane Studios, Empowerment photographer and those in the studio’s employment

“shoot & session” means your photographic session with the studio where your photographs are taken

“client/s” means individual who engages the studio to produce photographs

| copyright |

1) It is agreed that the studio, retains the copyright to all images taken at your session. It is illegal, unethical and punishable by law to scan, copy or reproduce these images in any manner or medium unless you have purchased a limited copyright licence from Natasha Jane Studios. 

Likewise, clients cannot authorise any reproductions of images for commercial use, personal use, for photographic competition or display. Even though the pictures may be of you or your child, the studio owns the copyright to the images. The studio is the only entity who can crop, alter or modify any image produced at your session. 

2) Originals and digital files remain the property of the studio. It is agreed that the studio may use any image from our session for industry competitions and as required for reasonable general promotional material for the studio. The usage for any other purpose is to be renegotiated between the parties and requires specific permission from you, the client/s. 

While the digital files are available for purchase, copyright is retained by the studio and a limited release (for personal use only) is given for the files when they are purchased. 

A limited release means you are able to use your images for any purpose other than 1) sell them to a 3rd party 2) enter them into competitions 3) use them for commercial purposes.

| session and booking fee |

1) Sessions are booked by setting up the non-refundable pre payment plan the studio is closed on Sundays, which includes the session itself. OR by utilising a Gift Card given to you (this might have come from a friend or family member or from one of our partnered businesses).

The payment of our booking and session fee is to reserve your allocated shoot date, time, hair & makeup for one. Your session fee does not include any prints or products, including digital files. These are available for purchase at the time of your session - the minimum purchase amount is the lowest collection available at the time of your session.

Should you be unable to pay your deposit at the time of booking, the studio reserves the right to offer your time and date to other clients. Your fees and shoot date are not reserved until your booking fee has been paid and your contract signed.  

If you, your child or any attending individual is feeling unwell, please call to reschedule. The studio understands that sometimes, this happens. If you must cancel, please try to do so at least 48 hours prior to your session, in the case of not showing up for your session, you forfeit your entire booking/session fee/gift card. The booking and session fee is non-refundable but is transferrable for another date/time at the discretion of the photographer, permitting that it fall within the 5 day required notice to reschedule prior to your session date and time. 

| gift cards & certificates |

1) All vouchers are non refundable and not redeemable for cash, and must be used by the expiry date on the voucher. 

2) full voucher amount must be used in the the same session and can not be carried over to another service on a different date. 

3) you must register your voucher via the QR code on the back of the voucher and bring your voucher with you to your session in order to exchange for services. 

4) Standard rescheduling times and fee apply to all vouchers. minimum of 5 days notice to reschedule, rescheduling is subject to a $150 rescheduling fee, which will need to be paid before a new session date and time is secured and can not be paid from your voucher. a minimum of 24 hours notice is required to avoid a 50% fee of the total voucher. the voucher is void if booked session is not attended. 

free session voucher offer all free session vouchers must be used with in 12 months of receiving your voucher, the full session fee of $400 for a weekday day session with an additional fee of $200 for all Saturday sessions must be paid to secure your date and time. which will then be credited back to you as product credit for your session products. all free session offers/vouchers are subject to the full terms and conditions.    

re-shoots | attendance | other photographers |

1) Re-shoots are at the discretion of the studio and are not given for regretful personal choices such a hair colouring, nail polish choice, clothing, or for non-compliant children on the day of the session.

2) To avoid disruption to the photographic coverage and to allow the studio to fulfil its agreed duty, other photography, videography etc by family/friends during the shoot is not permitted. If you wish to record your session for prosperity reasons, please discuss this with your photographer. 

3) Attendance at your photo session is limited to those individuals being photographed. In the case of children and newborns, attendance is limited to 2 parents only (if more parents or grandparents are wishing to attend please discuss this with the studio). Siblings are welcome if they are to be photographed as well. In order to minimise distractions and ensure a more productive and successful session it is recommended that the number of persons present be kept to an absolute minimum.

Ordering & Photographic Experience

1. The negatives/digital files remain the property of Natasha Jane Studios and will be kept on file a period of 2 months for re-orders. all images not purchased on the day of your session are deleted immediately 

Regarding ordering photographs, I/we also understand:

2. Orders must be placed on the day of your photo session (Same Day Ordering)

3. All orders are final and no changes to your order can be made once your session is finalised

4. All orders must be confirmed by full payment on the day of your session unless prior arrangement with Natasha Jane Studios had been made. 

5. All orders shall remain the property of Natasha Jane Studios until full payment has been made. Orders cannot be separated for collection unless paid for in full.

6.You shall pay Natasha Jane Studios for all cost incurred by Natasha Jane Studios including costs for which Natasha Jane Studios may be contingently liable in any attempt to collect monies owed by you to Natasha Jane Studios under this Agreement including debt collection agent costs, repossession costs, location search costs, process server costs and solicitor costs on a solicitor/client basis.

7. Natasha Jane Studios has no control over the environment in which the photographs are kept at the client(s) property and that colour photographs, in common with all sensitised material and colour dyes, have limited life expectancy which is minimised when exposed to strong and prolonged sunlight, heat or fluorescent light sources. Photographs will last longer if displayed under better lighting conditions.

8. In house laybuy & financing is available for all photographic purchases. In house layby requires 25% deposit. and the balance to be paid in full over 12 weeks. Physical printed products will be ordered immediately after your ordering appointment and delivered to you the client once final payment is received. Digital Client Galleries will also be sent once final payment for package has been made. Afterpay & Zip are also available. 

9. Your ordered products will be ready for collection within 4-6 weeks (depending on your order). these time frames are an estimate and some times circumstances can cause delays such as postal services. We will contact you to arrange a convenient time for you to collect your order from our Kirwan Studio.

10. In the unfortunate event that payment is not received the studio retains the right to claim any and all legal and collection fees pertaining to the outstanding invoice.

| Cancellation or Rescheduling |

1.Client must notify Natasha Jane Studios at least 5 days in advance if requiring to reschedule a session. One rescheduling appointment is ok under illness, if require rescheduling more than once a $150 session fee will be invoiced to client and must be paid before the agreed new date.

2.Session fee's are non refundable with all cancellations, all monies paid to wards your session, from session fee or by pre payment are forfeited upon cancelling your session.  

3.Natasha Jane Studios reserves the right to cancel or stop the Photography Session or otherwise deny services at any time if Natasha Jane Studios believe that Client is in possession or under the influence of Alcohol an illegal substance or prescription drugs that hinder client's cooperation during photography session.

| refunds | 

1. Due to the custom nature of our products, we cannot offer a refund or exchange on items once the order has been placed with our suppliers. If the product is damaged or faulty we will do our absolute best to make good or replace the faulty or damaged product. 

| delivery |

Delivery of all products take approximately 8-10 weeks from final payment being made.

| In house Pre session payment payment pan - Boudie Bank |

our interest free in house pre- payment plan is done through a direct debit system with pay advantage with no credit checks required. pay advantage does charge a small fee per transaction. Recurring Direct Debits $0.88 from bank accounts, $0.88 + 1.87% from credit cards, $5.50 / dishonour, $0.35/ reminder. All pre payments made towards your session are non refundable, however are transferable to another date within the same calendar year.

1. All sales are final. All payments made are non refundable. In the event that the client decides to cancel their session, All monies paid for session fee and all payments made for the pre session payment plan are forfeited and not transferable.

2. Should the client reschedule their session, the session fee and all pre session payments will be transferred to the new date, as long as it falls within the same calendar year.

3. Payments will be processed either, weekly, fortnightly or monthly based on client request. Payments are automatically direct debited through pay advantage once authorisation is confirmed by client.

4. We require 2 credit card numbers to keep on file for your payment plan, for instances when the initial card might be declined. You must notify us one week (7 days) in advance if you wish to have a new card added to your payment plan, the same goes for having one removed. You must keep a minimum of 2 cards on file at all time. A $1.00 charge will be processed on the new card to ensure the correct account information was received.

5. Should at any point you decide to cease payments on your order and cancel your session, any monies paid will be forfeited. Payments may not be used as studio credit or transferred to another session or another client. By opting to cancel, you are agreeing to receiving no product, digital or physical, and no images.

6. With Pre-Session Payment Plans pay advantage charges a small fee per transaction. Recurring Direct Debits $0.88 from bank accounts, $0.88 + 1.87% from credit cards, $5.50 / dishonour, $0.35/ reminder. Failed payments will be added to the next payment schedule along with any dishonour fees and debited together. after 3 declined payments we will cancel your pre-session payment plan and you will be responsible to pay in full at your Image Reveal & Ordering Appointment. Payment plans are NOT offered after the session, so please plan appropriately.

7. Bonuses, if applicable, must be chosen a minimum of 14 days prior to the date of the session. Bonuses are only available for clients who are pre purchasing a collection, and are not applicable to clients who are purchasing from the a la carte menu.

8. Should a bonus item or service become unavailable for any reason, the client may choose a different bonus the day of the session.

9. The entire balance of the Pre-Session Payment plan must be spent at the Image Reveal & Ordering appointment, directly after your photoshoot experience. If the client does not spend the entire balance, the remaining funds will be forfeited. No refunds or credits will be offered on remaining funds.

10. The Image Reveal & Ordering appointment is your one opportunity to purchase your images. Unpurchased images are deleted directly after the ordering appointment, Purchased images are Archived 30 days after prints have been picked up. Once Archived, there will be a $250 unarchiving fee.

11. Should the client issue a charge back with their financial provider, the photographer will issue a claim with collections and legal action will be taken via small claims court

| In house Lay-by payment pan - ONLY OFFERED TO THOSE ON A PRE SESSION PAYMENT PLAN |

our interest free in house layby payment plan is done through a direct debit system with pay advantage with no credit checks required, a minimum of 25% of your order must be paid on the day of your session with the remaining balance to be paid over 12 or 24 payments. pay advantage does charge a small fee per transaction. Recurring Direct Debits $0.88 from bank accounts, $0.88 + 1.87% from credit cards, $5.50 / dishonour, $0.35/ reminder. You understand and Acknowledge that due to the custom nature of the products, all sales are final and non refundable, you understand and acknowledge that any failed payments will result in additional dishonour fees and will result in your account being referred to small claims court or a third party debt collection agency for recovery Failure to make the agreed upon repayments of services already provided will result in your contract being cancelled and all monies paid forfeited. By failing to make replacement you are agreeing to receiving no product, digital or physical. 

* some banks may also charge a dishonour fee if payment amount is not available at the scheduled time. any dishonour fees from your bank is not in coalition with Natasha Jane Studios or pay advantage. 

Natasha Jane Studios

1. Should nominated photographer not be available for any reason, Natasha Jane Studios will notify the Client of the change as soon as it is known and provide another photographer with equivalent skills.

2a. The price quoted will be guaranteed for seven days otherwise the current price will be confirmed when the deposit on the order is paid. Any additional costs will be advised and confirmation required before proceeding.

2b. all collections offered by Natasha Jane Studios are subject to change, when booking a session you are securing the price of the session fee. all images and products are purchased seperatly at the veiwing and ordering session imidiatley following your photoshoot experiance.

2c. minimum spend at Natasha Jane Studios is the current lowest package at the time of your photoshoot experience. 

3. As the photographs made by Natasha Jane Studios are manufactured with the finest materials currently available, Natasha Jane Studios unconditionally guarantees them. If in your opinion any photograph made by Natasha Jane Studios has lost its original colour, Natasha Jane Studios will replace the photograph for fifty per cent of the current selling price. The original photograph must be returned and the reprinting charge paid in advance. This warranty will be valid for as long as Natasha Jane Studios has its possession the original files in a printable condition.

4. The negatives/digital files remain the property of Natasha Jane Studios and will be kept on file a period of 2 months, after which time Natasha Jane Studios will archive the images. A unarchiving fee of $250 will be required at that time, should you wish the review them in studio. 

5. Natasha Jane Studios shall carry out this assignment with due and professional diligence. Elements beyond Natasha Jane Studios control include faulty material, equipment failure, damaged and exposed film, loss of film/photos/negatives/digital files in transit between Natasha Jane Studios and professional laboratories employed by Natasha Jane Studios, loss or damage to film, negatives/digital files and proofs during processing and developing either by Natasha Jane Studios or professional laboratories employed by Natasha Jane Studios, industrial disputes, civil disturbances, or weather conditions which may inhibit or prevent Natasha Jane Studios completing in whole or in part this assignment. In this case Natasha Jane Studios shall not be liable for its complete performance of the assignment. It is agreed that the liability of Natasha Jane Studios shall be limited to be a refund of any money paid under this agreement which shall be in full & final satisfaction of any damage or loss suffered.

6. Behind the scenes photos on mobile devices is allowed during the photography session with Natasha's approval. 

7. Images presented to the client are the only images available

8. Standard editing includes minor retouches of blemishes, scratches, and skin softening. Examples of editing that is not covered include: Body manipulation - fixing tan lines, changing your body shape or altering body appearance or essive change to lighting after the image is taken.

9. Final images supplied may have slight retouching

10. Client is responsible for backing up and properly storing all digital files purchase

11. I agree that the Photographer may use images from the session (with my approval) with or without my name for any lawful purpose, including but not limited to publicity, illustration, advertising and web content

12. Waiver of Liability: The client expressly releases the photographer from all claims, damages, and liabilities that may result from accidents or incidents that occur during the portrait session. This waiver of liability includes waiver of any claim that may be a result of negligence

The person signing this contract agrees to act as a representative of all people photographed, and represents their agreement to these terms and conditions. I have read, understand, and agree to the terms and conditions of this agreement. Each person signing as "Client" below agree to the terms of this agreement.

I confirm that I have read and understood this contract terms & conditions, as also stated on Natasha Jane Studios website and I agree to enter into this contract with Natasha Jane Studios 

| monitor calibration | 

1 Clients are to be made aware that there may be slight colour differences between what they view on their home computer compared to what is printed. This is due to the differences in monitor calibration. All monitors used by the studio are fully calibrated and are matched to the profile of our professional labs. This colour variation also applies to press printed products such as greeting cards. In short, if you print from Big W and they don’t look the same as from a pro-lab, it is due to the poor quality of the print, not the digital file provided by the studio.
